Legal Question in Consumer Law in Florida

Breach of Contract or my fault?

I purchased a used car 1 year ago from a dealership. The salesman showed me a car and told me that there was NO previous owner and that the car was a courtesy car for a short time and it had a FULL warranty. So I bought this car. About 6 weeks ago I went to the dealer with ALOT of noises comming from my front end. They called me back with a long list of repairs and told me that it appeared the car was in an accident and that its not under warranty. So as I went through the chain of command some of the information I obtained from their personel was ''At that time we had a problem with our certification department''. I got no resolve at the dealer and called their local corp. offices where they pulled the VIN and said ''the previous owner got into several accidents and had extensive repairs on the front end, this car should've never been certified or had a warranty''. Today, I got a call from the GM who told me that I hit a pothole thereby voiding the warranty. Now, in my purchase agreement it states I have full warranty, I have NEVER been in an accident with that car or hit any pothole that would cause that much damage AND I learned all this info along the way about the prior owner and damage. What can I do?

Re: Breach of Contract or my fault?

Do you want them to take back the car, or do you want them to honor the warranty?

They obviously have no qualms about lying to you. Therefore you should deal with the dealership only in writing.

If they do not promptly resolve this matter, then consider filing a complaint with the Attorney General's office. You can find a link from my website http://firms.findlaw.com/elliotg/links.htm.

You should schedule a formal consultation with a lawyer. Most attorneys either provide a free, or charge a nominal fee, for an initial consultation.
