Legal Question in Consumer Law in Florida
underage contract
My son was contacted by a timeshare corporation on his cell phone. He agreed to buy a vacation package, for which he was charged $500. He is 19 years old. In looking at the package details, it says that he must be 21 to use the package. He bought the package as a gift for us. At the time of his call, he was assured that we could use the package without charge. Now I find that there is a charge for us to use it, and because he is under 21, he cannot use it. I have tried talking with the timeshare company, but they are uncooperative. I want his $500 refunded. They claim that he said he was 21; he says that he told them he was not. Is the contract legal? Can we get his money back? We live in Maryland, and the timeshare is in Florida.
