Legal Question in Credit and Debt Law in Florida

15 year old debt

i received a letter from an attourney today saying i owe 8500 dollars for an account from the early 90's that was originally sears.

It has been on my credit report since then but taken over by different companies/attourneys in between, so it always stayed on . I never paid because i was told by the credit bueraus that it will be taken off automatically and not to worry.

Right now it is not on any of my creditreports, but i get a letter to

pay 8500 to this attourney.

Original debt was about 800 dollars or so. what can i do to prevent paying this much. I cannot afford it.

Re: 15 year old debt

I have had great success in defeating these third party purchasers of bad debt. There seems to be violations of the Florida Collection Practices Act as well as possible statute of limitations issues. Feel free to call me to review the relevant documents.

Re: 15 year old debt

You need to send them a certified letter that you dispute the debt and to cease and desist calling you pursuant to the Fair Debt Collection Practices Act. If they do continue to contact you other than to sue you, then you can sue them for violation of the statute. They are trying to get you to make a small payment to start the statute of limitations on the entire debt all over again. If you would like to discuss, please call my office.
