80 year old mother with large charged off debt
My mother is 80 years old and receives $670 per month in Social Security. She has no other assets. She now lives with my husband and myself in our 1 bedroom apartment, after suffering a heart attack last year. We are struggling ourselves, and cannot assist her financially. She has over $20,000 of unsecured debt, some of it which has been charged off. I am shielding her from any phone calls, as I am concerned for her health, however, I am now a wreck. We signed her up with a non-profit credit counseling service, but are concerned because the charged off accounts don't want to do negotiate with them at all. What do we do?

You are not responsible for the debt, unless you, in writing, ageed to pay the debt. Your mother has no assets from which any judgment could be satisfied. She is 'judgment-proof'. Although it is not necessary if you wish, your mother could file for bankruptcy protection. If she, does I urge you to do it now....before the new act becomes effective.
