Legal Question in Credit and Debt Law in Florida

Not my account!! Prove it....nothing was signed by me.

What proof is required in order for a collection agency to place an account on your credit report. I lived with my father back in 2003 he leased a home. At the time I was unemployed and was only listed as other on the application. I contacted the collection agency and stated this to them the insisted that I was responsible and that I had signed the lease. I requested all the information they had on the account be mailed to me. A few days later I recieved the paperwork which included: an apllication which my father signed as head and his room mate signed as co-head. Me and my daughter were listed as others in home, copies of my fathers ID and insurance cards, his room mate's ID, a contractors BID for repairs to the home after move-out, and a move-out form that has Redients name as my fathers&Mine. The collection ageny contacted me the next day and asked if I has received the information, I stated that I had and wanted to know how they could place this account on my credit when I never signed a lease. I never agreed I would be responsible for anything in the home. The woman I was speaking to insisted that the signature at the bottom of the application was my signature (which was for the head of house to sign) it was my fathers.

It sounds like the account is not yours. You can write the credit agencies and request an investigation with your facts. If they refuse to remove it, you would need a lawyer.
