Legal Question in Credit and Debt Law in Florida

Credit card debit of deceased husband

My mother's husband is deceased he passed dec 30, 2007. He had credit cards 2 in particular that she didnt know about one card had a limit of $20000.00 and the other $3000.00. The $20000.00 card said shes not responsible for his debt and the other is threatening her saying they are going to seize all her assets, her house, cars, and all other products. I am looking for the stautue, bill, or law that states that she isn't responsible for his debt, which she knew nothing about, the cards weren't in her name only his. His estate is the house which is in the process of being sold in a few years. This is all he left my mother. Please help me find this statue in florida thank you. Heather

Re: Credit card debit of deceased husband

They cannot come after her personally if she was not on the cards. They can seek to make a claim against the estate for the debt but unless they do that before the estate legally disburses funds then she is ok. Of course, the estate is obligated to notify creditors. You probably want to talk to an estates attorney.
