Does a creditor have a right to contact your employer and garnish your wages without a court judgement?

Absolutely not. No creditor can garnish your wages without first obtaining a court judgment. If you are the head of your household, your wages can not be garnished under Florida law except for a few reasons including child support. If this is happening, you need to consult an attorney immediately so that appropriate steps can be taken to stop this illegal action.

They can through a debt collection agency. However, if you tell them to stop contacting you at work they must under the FDCPA. They cannot garnish your wages without first getting a judgment against you.
