Legal Question in Credit and Debt Law in Florida
Fraud
I discovered that there was fraud on
my bank account - someone signed me
up for a lot of loans. The bank is
looking into it and I have a police
report, but I am still being hounded by
rude collection agencies. What can I
do?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
Generally if you send them a copy of the police report, they will cut you some slack and allow the investigation to take its natural course. If not, you may wish to go over the collection agency's head and speak directly with the fraud prevention department or collection manager of the lendor/creditor to try and get some temporary relief from further collection activities. You should also ask the collection agency to provide proof of the debt within 30 days as required by law.
