Legal Question in Credit and Debt Law in Florida
invoiced for non payment
I am recieving letters to pay for molding that was a gift over a year ago. I did not order or recieve any invoice until over a year. At the same time I did recieve a gift of a hardwood floor and no invoice was signed or sent. I would like to know my legal rights to not pay for this.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
If you did not agree to pay for the molding then you generally cannot be held responsible. There appears to be much more to this story than you have said. If so, I would suggest you meet with an attorney and provide all of the facts. The attorney can then give you specific advice as to your rights and responsibilities.

You cannot be sued on a gift. However, the invoices suggest that the other side doesn't see it as a gift. Something must have happened. I suggest you contact a lawyer. If you would like to contact my office, I would be happy to hear from you.
