Legal Question in Credit and Debt Law in Florida
I had a settlement agreement where monthly payment were automatically deducted from my account on a monthly basis. The settlement indicated that 68 payments were to be drafted from my checking account. The attornry who was handling this collection exceeded the 68 payments, and when i contacted the law office in June they adviced me that I was owed $375.00. I adviced the attorney by phone and in writting of my current address since I have not lived at the address they had on file since 2004. As per my last conversation with the attorney in July, the check was mailed to the previous address and they have not received it. I was told i would have to pay for a stop payment, but I don't believe i should since i did advice them of my current address. What can i do to get the money that is owed to me?

Well, whose fault was it that they had a wrong address? Did you tell them when you moved? And are you really going to argue over a lousy $35 or so stop payment fee? I understand the principle of the thing, but is it really worth the hassle. My law partner has a good saying, "Don't die on every hill."
