Small Claims Court

My mother in law paid for my husbands divorce and now she wants us to pay the balance. She was ready to whip out the credit card when we couldn't get our children back from his ex-wife. She said it was her fault and that she would do anything to get the kids back so the divorce was the only thing we could do and get custody. She paid for the divorce and then we said we would pay for what we could we paid for 1 year and now she is threatening to sue us for the remaining balance. We did not say that we would pay it back we said we would help do what we could but we have 3 children and she doesn't seem to understand that they need to be fed. Does she have any legal grounds? There is no signed legal documents binding my husband to repay the money. what can she really do?

It is her word against yours whether there was an agreement to repay. In small claims court, the Judge will decide who he believes more. Depending on the amount, you may want to consult an attorney.
