written response requested for credit card debt
I received a summons to respond in writing if I want the court to hear my case reguarding a credit card debt. I do not dispute the debt but the letter states that if I do not file on time I may lose the case and my wages, money and property may be taken without further warning from the court. The debt exceeds 15,000 dollars. I would like to know if they are able to take or put a lein against my home in this case and how I should respond to the summons.

You should hire a lawyer. The can put a lien on your property once they get a judgement however they can not take your home because of homestead. Please contact my office should you wish to hire a lawyer.

you should respond to the summons and verify with your records the amount owed. a lawyer can help you assert all defenses you may raise

You should get an attorney. Even if you don't dispute the debt, they will add all sorts of costs and attorney fees to the debt, plus interest, if you don't at least file an appearance to defend. Also, they can lien your home unless it is subject to a homestead exemption.
