Legal Question in Criminal Law in Florida
my brother was tried and sentenced in 2004 to 20 years in prison. His charges are as follows: additional offenses-felony offense level 4 for fleeing and eluding-high speed chase;felony level 6 for aggravated assault on a leo;felony level 5 resisting officer with violence(which was changed from felony dui level 3);prior offenses-dui misd;driving while liscence suspended misd;criminal mischief misd;disorderly intoxication misd;resisting officer with violence level 5 felony;battery on leo level 4 felony; and the primary offense being throwing a deadly missle felony level 4. He had a criminal punishment score sheet prepared for the same sentence hearing being the first of 50 points, then the second of 86 points. He has served 5 years and is now going for a clemency hearing, and i would like to know if there is anything that would make him stand out and be approved for early release.
1 Answer from Attorneys
You should them know how his life has changed since the sentencing. That can include things like schooling, drug or alcohol treatment, service within the prison, and a show of remorse. Not saying that anybody will change their mind but those are the kinds of things they look for.
