The detective doesn't open the case back up, the State Attorney would. If you file a motion yourself to get the property back, the State Attorney could possibly refile charges right there while you are in the courtroom. It would be best to hire an attorney that can make a special appearance on your behalf and argue the motion for return of property.
If you would like to discuss your case further you can call my offices in Miami.
