Legal Question in Criminal Law in Florida
Mandatory 30 year sentence
My nephew was recently sentenced to 30 years (mandatory) as a result of being a Repeat Offender. Unfortuantely, he had a PD, so she decided it was easier to plead out rather than fight it in court. Had we been able to affor a real attorney, I believe he may have gotten 10 - 15 years. My question is, can a sentence be appealed because of ineffectual representation? I basically just need to know if there is such a thing as an appeal to this? Thank You

Yes you can appeal on ineffective assistance but I would say it is rarely ever successful. If he pled to a mandatory 30 no one not even a "real" lawyer could have changed the sentence. Be advised most of the attorneys on this site were once PDs.
