Legal Question in Criminal Law in Florida
Our neighbor gave me her puppy a week ago and now wants it back. We couldn't take care of it so we gave it away to a friend, along with the health records I got from the original owners. Now she is threatening me with legal action because I can't return the dog. Am I in any legal danger?
1 Answer from Attorneys
You are likely not in any legal danger. Your neighbor can still sue but she will likely lose. Unless there was an agreement that she could take the puppy back within a time frame, once she gave the puppy to you she lost all rights to the puppy. Therefore, you were free to do whatever you wanted to do with it. She basically gave you the puppy as a gift and she no longer had any possessory interest in it. You were thus able to give the puppy away to someone else if you wanted to.
