When it comes to statute of limitations questions the answer depends on the severity of the charge. In Florida, a misdemeanor of the second degree must be commenced within one year of the alleged incident. For a misdemanor of the first degree the state has 2 years to commence prosecution. For felonies, 1st degree = 4 years, all other felonies = 3 years. You can research this matter yourself by looking at Florida Statute 775.15.
