Legal Question in Family Law in Florida
Child Custody
My child is living with both myself & her father. She lives with him from Mon. - Thurs. and with me from Fri. - Sun. We were never married. We have no legal custody paperwork. Her father registered our daughter in school because I couldnt. I went to the school to try & withdrawl or receive copies of our daughter's paperwork & they told me no and called him. He then called me & told me I couldnt see my daughter anymore? How do I handle this situation & can he do this? Who has custody if there isnt any custody paperwork in process? What paperwork do I need to file to get shared custody with me having rights to designate where my child lives? When going to pick up my daughter on Friday, do I need to bring the police since he is not letting me see her?

Re: Child Custody
You need to have custody determined by the court.
Re: Child Custody
You both stand on equal footing in the eyes of the law. You need to hire an attorney and get to court. The police are not going to involve themselves in what is a civil matter.
Re: Child Custody
You need to file a Petition to Determine Paternity and for Other Related Relief.

If your situation falls within the Greater Tampa Bay area, I would be happy to schedule you for a no obligation half hour office consultation. The main office is in Largo, with a satellite location in Tampa.
