what should i expect?
My family law case Pre Trial hearing is going to be scheduled for sometime in January. I was just wondering what that type of a hearing is, and exactly what to expect. My ex spouse and I have been divorced for more then ten years and the only issue on the table is a modification of primary residence for our minor child. We did go to mediation in July of this year, and stipulated to a Guardian Ad Litum for our case. They ahould be starting that very soon. Do we have to have a Pre Trial? When can we get a Final Hearing? Do you know what percentage of the time the Judge sides with the recomendations of the GAL?

I would require additional information before I can answer in too much detail. Depends on what type of action is before the court-is it for a modification of custody and/or relocation to another state? The burden is on the party bringing the petition(s). I find that the judges do not have an automatic preference either for the mothers or fathers.
If this is a contested matter, and if it is scheduled for a protracted hearing, then the court schedules a pre-trial conference to determine how long the case will take, whether it can settle, and if not, what are the issues, what evidence will there be, and who will be the witnesses.
