Legal Question in Family Law in Florida
I need legal advice on how to move forward. My ex husband and I split up due to domestic violence. He tried to kill me when I wanted to leave. The judge had us do shared custody of our children and he did not end up getting charged for anything against the wishes of dcf, ffn, and myself. I am nowrecently remarried and my kids went to spend the summer with their dad last week. He has just stated that the children are saying they are afraid of me and my new husband and that we abuse them with a belt. He stated that my six year old wants to live with him now and that dcf could be getting involved. This man has continuously made my life hell but I have done my best not to let the children see it. My question is, what can I do legally to protect my kids and myself? I attempted to file papers a few months back when he decided to change the amount of child support. I had talked with my lawyer and he stated that we would end up with the same judge who didn't help my situation at all. This accusation was made yesterday and nothing was open to file anything yet. I'm not quite sure what to even file.

You have an attorney; trust your attorney or replace them. No ethical attorney will give advice to a client who has retained an attorney.
Change attorneys. Sounds like this guy is bad news. Check around the court house and see who is up for the job =. These girls that work there can tell you what you need to know then go hire that attorney. You need to put this guy in contempt , he is trying to alienate you from the children by instilling fear in them. Get a social evaluator involved and have them go out and take a look at the living environment, school situation, their friends, their teachers, neighbors, work, jobs, bosses, etc.
