Legal Question in Family Law in Florida

I live in Florida. My son's father, who has never met him, wants to petition for custody. My living arrangements are not as comfortable as his but my son is a happy and healthy 1 year old who gets everything he needs and wants. My son is very dependent on me. He's only ever been away from me for a few hours at a time. What are the chances that he gets custody if we go to court?

Depends totally on the Judge and the facts of the case. DO NOT represent yourself, hire an experienced attorney.

My colleague Mr. McCall is absolutely correct. You need to hire an attorney. If you can not afford one, then please look into the Legal Aid offices in your area. In Jacksonville, we have Three Rivers and Jacksonville Area Legal Aid. Either office could assist you.

The issue is this: If he is proven to be the father, then he is allowed visitation rights. If there is some concern as to the bio dad being an alcoholic/drug/abuser - then there would be the issue of supervised visitation which he would pay for. If you named him on the birth certificate, then he has the right to file for visitation. As to full custody - therein again lies the question, what is your background, is the child safe, healthy etc.
