If you are filing for a divorce in Florida, then you are entitled to one-half of his retirement. Just make sure that you inform your attorney of this retirement to be certain that it will be included with the other assets of the marriage for purposes of equitable distribution.

If your marriage has been dissolved and the Final Judgment does not include any right to the military pension, you will have to file a post-judgment action to claim rights and explain the reasons why such claim was not made. You are entitled to one-half of the pension accrued during the marriage, however, your rights may be affected by other factors.
