With that assumption in mind, Georgia law allows a stepparent to adopt their stepchild, if done with the stepparent's spouse's consent and over the other parent's objection if the other parent has either failed to support the child for over 12 months or failed to communicate with the child for over 12 months. There is a question over which state would have jurisdiction and therefore which state's laws regarding stepparent adoption would apply and I would encourage you to speak with an attorney to determine that issue after going over all of the facts with him or her.
