how to get someone's parental rights terminated

My husband has custody of his daughter with shared parental responsibilities for the mother. She has supervised visitation with our child and her three other chidren whom are in the custody of their father. Is there any way to get her rights terminated to our daughter so that I can adopt her? p.s. she was ordered to pay child support starting nov. 05 but has not paid one cent yet.

Your question indicates you are in Georgia and the Question relates to Florida law. I am not admitted to practice in Florida and so could not answer the question as to Florida law, but it appears from your question that the answer might truly be based on Georgia law, since you and the child are here. With that assumption in mind, Georgia law allows a stepparent to adopt their stepchild, if done with the stepparent's spouse's consent and over the other parent's objection if the other parent has either failed to support the child for over 12 months or failed to communicate with the child for over 12 months. There is a question over which state would have jurisdiction and therefore which state's laws regarding stepparent adoption would apply and I would encourage you to speak with an attorney to determine that issue after going over all of the facts with him or her.
