Legal Question in Medical Leave in Florida

Family and Medical Leave Act

My father has had a drug addiction problem for the past 7 years. It is getting worse and worse and myself and my family strongly believe he needs intensive inpatient care, which he won't voluntary do. One of his reasons to not go in is the fear of losing his job. How much time is he allowed to have off with the FMLA and what are his rights?

Re: Family and Medical Leave Act

So sorry for your father and your family.

Under the FMLA, an employee has the right to twelve weeks of unpaid leave for a serious medical condition as long as certain conditions have been met. Go to www.dol.gov and click on the FMLA section - that will explain his rights. The employer has to replace him in his job upon his return and keep his benefits in place during FMLA leave. Good luck.
