VA Hospital Employee Coverage

Does the FMLA apply to VA Hospital Food Service employees and does the VA have to maintain your health insurance benifits during the leave?

The FMLA applies to all public agencies as well as to private employers with more than 50 employees. I am not aware of any exemption for the VA or its employees.

During the leave, benefits must be maintained to the same extent as during employment. For example, if you had health insurance with a copay, it must remain available to you during the leave.

Also, you must be returned to the same or an equivalent position if you are able to return within the 12 week leave period.
