calculating basis for lawyer's contingency fee

My wife and I were rear-ended and have undergone medical treatment. Some of the bills are still due and we're told not covered by insurance. Our lawyer settled the case with the insurance company. He has taken his 33-1/3% fee out of the sttlement total. When we pay the outstanding medical bills, we will receive less money than the lawyer. Is that possible? Shouldn't his fee come from the ''net'' amount after bills are paid?

Unless your agreement specified his fee was to be on the net after payment of bills, the attorney fee is based on the gross settlement.
