Legal Question in Civil Litigation in Florida

cancelling a check

I cancelled a check I wrote to an accountant because he did my taxes all wrong and now i need to pay another acocountant and also tax penalties and interest, because he took a whole year to finish the returns. Today a detective called saying I have to pay the $500 or he will have to put out a warrent for me. Can they have me arrested? How can I fight back?

Re: cancelling a check

You could be arrested for issuing a worthless check, in Florida it is a misdemeanor.

In your case it sounds like you have a legitimate defense.

You do have a problem on your hands though. If you pay the detective you could still be arrested because the crime technically occurs at the time you wrote the check. If you dont pay the check you could also be arrested.

I would probably contact an attorney and try to arrange to have the attorney structure the deal where you would be granted immunity from prosecution in exchange for payment on the check.

Hope that helps,
