Legal Question in Civil Litigation in Florida

I am a co-defendant with my ex-husband in a claw back lawsuit filed by investors who lost money in a pyramid scheme. The attorney for the plaintiffs is trying to get me to settle out of court. The total amount is $18,000 to be split between us. My ex is trying to negotiate a 70% settlement. My ex has an attorney negotiating for him, I don't. Because we are co- defendants, I don't believe we can make separate negotiations, can we? Neither of us have spoken directly to the other in the matter. If I do nothing,and he makes a settlement arrangement, what happens to me? Will I pay 50 % of what he settles for or 50% of the original unnegotiated amount?

You are a separate defendant and nothing negotiated by your husband controls you unless you agree to it. Likewise, any settlement he makes may not benefit you. You can negotiate a separate or joint settlement as you see fit. You should consult with your own attorney if you have any doubts or questions about your situation.
