Legal Question in Civil Litigation in Florida

old debt-repossession

My husband contacted a finance company a few months ago in regards to financing a boat for him. He did not realize that it is the same company which financed him a vehicle (with his deceased mother as a co-signor) many years ago and have since been calling his place of employment and telling the office staff that they will be contacting the corporate office in order to have his wages garnished. Can they do that? What should I do, I have just been laid off and like everyone else, times are very hard.

Re: old debt-repossession

They can't garnish his wages if they don't have a judgment against him. As the breadwinner, his wages may still be protected under Florida law even if the do have a judgment against him. You also might consider speaking with a bankruptcy lawyer.
