Legal Question in Civil Litigation in Florida
false advertising
I answered an ad in my local paper
regarding employment. The ad
stated emphattically, '' Earn $1000-
$2000 a week guaranteed..'' when I
called to enquire about the posistion
I was told that it was a comission
only posistion selling discount
medical plans. When I asked how
they could ''Guarantee'' me at least
1k a week when I know for a fact
(having been a salesman most of my
life that there are no guarantees in
life much less in sALES, I was told
that the leads were sooo good that
there was no way I wouldnt earn
that ammount in a week. Is there a
lawsuit here and if so what type of
layyer would be interested in such a
case?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
As a salesman, you admit that you knew better nor have you mentioned any losses incurred by you or any other kind of damages. Frankly, ads like this are "a dime a dozen" and everyone knows they are false or misleading. Usually in the small print they say that the results may not be typical or something like that. You have not exhibited any grounds or basis for a legal action.
