Fence company did not deliver on services promised

I gave a fencing company $2500 as down payment on the building of 2 fences and repairs on an additional fence on my rental properties in the middle of July. I have not seen him since. His response to the BBB was that he delivered the goods and I signed off on them. How can I get my money back from this guy without spending all of it on attorneys fees? Can I file a law suit myself?

Go to the local court house. Ask for a small claims package. Fill out the package. Check off the boxes that apply to your case. Go on-line on Sunbiz.org. Look for the company's name. Print out the information. Bring it with you to the court. You will need to put the registered agent's name on the summons to be served. He is not to be included in the lawsuit, he is just the person to be served with your "Statement of Claim" Bring "copies" of all documents to attach to the "Statement of Claim." This will be included in the package that you receive from the local courthouse. Your claim will be long in Small Claims Court, which should be in the same courthouse. Good luck, and any more questions you have can probably be answered by the clerk at the courthouse. Bring cash as well because you will have to pay for filing your lawsuit. Good luck,
