Legal Question in Civil Litigation in Florida
MY Mother, accidently, sent a check belonging to a Credit Card company to Comcast,,over $500 instead their check of $77 in-which,She sent to the Credit Card Company
She always paid both on time,BUT in these hard times she cannot afford to pay $500 twice and get the run around from Comcast on check that shouldn't been able to cash in the first place.
...At this point she has not been able to get any satisfaction from Comcast,,,I guess they're trying to keep the rest of money and credit the account,,,She cannot afford it! She's 75 and stressing out!!
1 Answer from Attorneys
They do not have a right to hold funds they are not entitled to, nor did they have the right to cash the check, which should have been returned. Call them and demand a supervisor return her money immediately. If they give you a hard time try calling the bank that accepted the check (not your mother's bank) and explain that an authorized check was deposited by Comcast against your mother's account. If Comcast refuses to return the money contact a lawyer who practices consumer protection law. Under most consumer protection statutes attorney's fees are awarded by law and you will not have to pay the attorney.
