Negligent care to puppy

3 month old puppy came from breeder. She had been given 4 shots which incleded parvo prevention. The Vet continued with her shots - 2 more series & her rabies shot. Pup is now 5 months pld & has parvo. Vet did not continue with her parvo shots which should have been done up till 4 months of age. Dog now has parvo & our vet bills are now at $2650 & climbing. 80% chance the pup will survive. He also did not diagnose her with parvo. He did not know what was wrong with her. Later that night we had to take her to the emergency vet. WE requested a parvo test. It came back positive.

Dogs in Florida are considered chattels or goods. Your only damages are limited to actual damages incurred. You might have a claim against the breeder on a contract action if you can show they misrepresented the status of the health of your puppy or if they never gave the required shots which they claim they did.

You may also have some claim for the cost of the vets bills against either your vet who failed to diagnose the puppy with parvo or against the breeder. There are attorneys in Florida who do accept cases of this nature and are more qualified than others. You should seek one out to review this matter with you.
