You must appear live if you are the defendant. Want to know the law without going to law school? Protect yourself against ripoffs? Sign up for a free legal newsletter on various areas of consumer law by going to www.ConsumerLawyerHelp.com.

You didn't say who you are in the litigation. You can ask to appear telephonically too if you are the defendant.

If you are the defendant, under your scenario, then you call in unless you, too, request the right to appear by phone or if the court's order permitted anyone. If two will be on the phone, you will need to arrange for a conference call.
