Legal Question in Civil Litigation in Florida
I was shopping for a service company. I found one that I was inclined to deal with. after a short conversation, I told the owner that I need to talk to my wife to make a final decision. In a few minutes I got an email and a phone message telling me to go back to my country and to learn to respect native Americans. He also cursed me in his written and verbal messages.It took me 2 days to recover from that message. I am an American citizen, but I do have an accent. I would like to file a legal action, if it is possible.

Unfortunately, I do not think there is legal action to be filed. I agree with you that his behavior and language were inappropriate, however, being an American allows everyone certain rights, freedom of speech being one of them. While not all speech is pleasant, it is generally allowed. Even in Michigan, where it is illegal to curse within ear shot of a child, I do not believe this situation would qualify for criminal action. I wish our American citizens were more open minded and accepting of all people, since I believe that is what this country was founded upon, however, I cannot change mean people. Based on what you wrote, it does not sound like you have a cause of action. I am sorry this happened to you. You can share your experience (or emails) with this company with others, so they know the truth about this company and its owner. Regards,
