Legal Question in Civil Litigation in Florida

Being sued for damages

I wrecked my truck while driving drunk into an illegally parked truck. Subsequently, the truck I hit caused damages to four other vehicles. My insurance policy was apparently too small to cover all the damages. Two of the vehicles (the one I hit and another) were replaced or fixed by these individuals personal insurance. Now their insurance company is threatening me with a lawsuit, but not my insurance. The amounts they are requesting is far more than I can afford. What kind of options do I have? I know a lawyer is going to be important, but does it matter that the guy was illegally parked? I know I was wrong and have been ordered to pay restitution to the individuals (they're premiums) but what about the guy who also broke the law what is his legal responsibility?

Re: Being sued for damages

Contact your insurance company. Even though there is not enough insurance, they still provide a lawyer to you. You can negotiate a settlement with the people suing you and hopefully arrange for monthly payments of some type.

Re: Being sued for damages

You should get an attorney. Your options are to argue that the person whose car was illegally parked was also partially negligent (known as comparative negligence) and try to negotiate a settlement or go to trial arguing to the jury that the other person should be assigned the greater degree of fault which minimizes your exposure. If you would like a consult, please feel free to contact my office.
