my boyfriend is filing for TPS he is a haitian national, on the form it ask if you have two or more misdermeanor and no he only has one but he got pulled over for driving on a suspended license and the found 20grams of pot on him....... my friend was helping filing out the form she said if it's more then 10grams he has to file a I-601 form but the charges were purged from the court house does he really have to file the I-601 or what else is he qulified to fill out he has a work permit he been here for 19years any help would be greatly appriciated

He must only complete the waiver (Form I-601) if he was convicted for possession of 30 grams or more. Your boyfriend really needs to be sure of what his actual charge was before submitting his paperwork. He really should consult an immigration attorney because even though the records may be purged locally, INS has a way of finding things. You do not want to file for TPS if it will lead to him being put in removal (deportation) proceedings when he can continue to fly under the radar as he is now.
