Legal Question in Immigration Law in Florida
My boyfriend and I have been together for three years and we want to get married but we are worried that because of his illegal status of more than 8 years would be a long and expensive process of him obtaining at least a permit or resident card or never obtaining anything.
His case is a bit complicated he was denied political asylum and has tried to appeal the case many times but unfortunately he is stuck with an unsolved case including his family. They have no asylum in USA but they can not be deported anywhere, he doesn't have a passport from Albania nor from Germany.
Please help me,
Maria Wilkinson

Dear Maria Wilkinson,
If your fiance was not ordered deported (there is no deportation order) AND entered the USA lawfully on a visa and HIS passport -- then, yes, he might be able to obtain a work permit and a green card based in a valid marriage to you, a US citizen. If some of the components are missing or you are not sure, you should definitely consult a knowledgeable immigration attorney for advice prior to making such an important dicision. What status he was granted by the immigration court? Did he have an attorney?
