Legal Question in Immigration Law in Florida
my friend is an Austrian citizen and her aunt and cousins are us citizens. is there a way for her aunt to apply on her behalf to stay in the US legally for longer than the 6 month visitor visa?
1 Answer from Attorneys
No, unfortunately, aunt or cousins can't help.
Aunt is not considered a close enough relative to be able to petition for her niece's or nephew's permanent residency (or anything else).
Aunt can petition for her sisters and brothers only. If niece/nephew is under 21, then there is a chance they can be included into the petition.
