Legal Question in Immigration Law in Florida

I am on H1B in US, we have just been blessed with a son. I want to apply an Indian Passport for my son. Do I need to apply for a H4 VISA for him ? What will be his legal status in India ?

A child born in the USA is a US citizen by birth (you didn't specify in your post if you son was born in US). He can have both Indian and US passports. No H4 visa is necessary for a US citizen.
