Legal Question in Immigration Law in Florida

My lawyer was disbarred since we hired him back in 2006. We recently paid him for a work visa back in September, the next week he was arrested and bonded out. Since our petion was denied for the greencard (because paperwork was not filed on time) he re applied in March of 2010. He has been avoiding our calls so we called the lawyer who signed our petion for the I-130 and he told us that our guy,has a warrant out for his arrest and is on the run!!!!!!!!! The lawyer who signed our papers told us there is nothing he can do for us because our guy who is on the run is the only with legal rights to our paperwork? Is this so? How do find out if he even filed our petion? Where do we go from here?

Call the USCIS 800 Customer Service number, have your A# ready (if you don't have a case number) and ask the customer service rep about the status of any pending petitions or applications. You can find their number at www.uscis. gov

On the other note, consult a knowledgeable immigration attorney, preferrably a member of AILA. If you are out of status, no work visa will help to correct your situation. You need to consult a lawyer about your legal options, not merely about pending application,
