marriage to illegal
my boyfriend came here from morocco on an educ visa. we have been togthr for about 3yrs now. we have been talking about marriage. he did not attend school last semester and he worked. he was trying to get back into school but it did not work out. he is now in a detention facility in another state. is that overstaying his visa? can we still get married?

Marriage to a US citizen can qualify one for lawful permanent residence, but why is he in a detention facility?
If he's under removal hearings, then it would need to be done in immigration court versus a standard adjustment of status.
