Legal Question in Immigration Law in Florida

I nephew is 6 yrs old. He lives in Venezuela. His mother died last month (my wife's sister). She was a single mother. If my wife and I have legal guardianship of him in Venezuela can we apply for his residency to bring him here to live with us. I am a US citizen and my wife is a legal US resident for 21 years. We live in Florida.
