Legal Question in Immigration Law in Florida

Hi if someone over stay there turist visa for almost 3 months, but there visa is good until 2013 can they try to come back?

once they try to come back, if the imigration at the airport send them home is that consider deportation?

If so, would that cause problem if this same person has one I130 filed on her behalf by her brother? It could cause a ten year bar or not?

Can she try to come back on turist visa and whe she gets change to a student visa?

If a person overstayed by 3 months, and then tries to come again on the same visa - he can be denied admission and his visa canceled.
