Legal Question in Immigration Law in Florida

With Temporary Green Card Spose status

If I dissolve my marriage with my husband who has a temporary Green Card, currently, regardless of me showing up on the interview with him or not, will he be getting his permanent Green card so is the Citizenship? I really would like to know , what will be his disadvantages?

Re: With Temporary Green Card Spose status

Dear Inquirer:

If you are no longer in a viable marriage, your husband will have to seek a waiver of the joint filing requirement to remove the condition on his resident status. He will need to show that he entered the marriage in good faith but it has been dissolved; that he has been battered or abused; that he will be persecuted in his home country; or that he would suffer extreme hardship if not allowed to stay in the US.

I recommend that you email [email protected] or visit www.hanlonlawgroup.com if you would like to schedule a consultation to discuss this mater further.

Yes, he might still be able to remove conditions from his conditional green card and become a USA citizen. He will need to show that marriage was not for the sole reason of obtaining a green card, and it was a real and "bona fide" marriage".
