You can sue but does she have any assets to pay a judgment? If you have underinsured coverage on your own auto policy you can make a claim against your own carrier.

Collection is always the problem and reason injured people accept policy limits even though less than damages. Suing for more does not get you more. You need an attorney to guide you through this. By the way mris don't establish relationship to an accident only a doctor can do they. An mri can determine if a problem is acute or chronic. The fact that you have a herniated disc does not mean it is from the accident alone.
