Legal Question in Insurance Law in Florida
Loss of Use or Loss of income
In Florida, do I owe loss of use if our insured totalled a cab. The cab company is only allowed to have 55 vehicles on the road and after the accident still had the same amount of vehicles on the road? I know that I would owe it to a individual whether or not they had a rental vehicle. I can not find any case law regarding this. The cab company cannot show me where they had less than 55 cars out on one day.

Re: Loss of Use or Loss of income
Your argument makes sense to me. If they could not have used the vehicle anyway I see no loss of use (unless they had to rent a vehicle).
