Can a person accept a settlement and sue in civil court too?
My mother was hit by a car while crossing the street in Florida in 2003. Is it possible to receive a settlement from the motorist insurance company as well as sue them on a personal level for damages?

The insurance company acts on behalf of the person who hit your mother. If you settle the claim with the insurance company they usually require you to sign a release which may well prevent you from suing the person personally.
