My Salary id 450.00 per week and I was told that overtime was not an option for me, but yet when I get a call no matter what time I have to respond with in an hour and each call takes from one hour too two hours depending on the drive.Am I in My rights to ask for over time pay?

Re: On Call Mortuary Driver

I do wage and hour law. However, I have not had a situation involving a mortuary service. The law provides for overtime and many exemptions. It is best to contact a lawyer to provide additional information and to see whether you should be paid overtime for the "waiting" hours. If you would like to contact my office, please do so.

The law entitles many occupations to overtime compensation and you may or may not be owed overtime wages depending on the particular circumstances of your position. You should contact a lawyer to review your specific situation and remember that until you take formal action, your claims may potentialy be reduced by the passage of time.
