Contract breach, theft and fraud

I am part of a group of 6 insurance agents who worked very hard for an agency under a contract and 1099. They were to supply us with correct accounting for monies that were earned. In 2006 we noticed that tens of thousands of dollare were missing from our accounts. Upon pressuring the company to follow thier contract and supply us with the correct accounting, the company began finding reasons to terminate us and keep all of our earnings. This amount to well over $250k among us. Not only had the company done this but they have reported 1099's to the IRS in well over what was earned. We also have a letter from the owner and his bookeeper stating that they charged us 3% interest monthly on commissions paid. Thats 36% per year. We need help stopping this guy. Our contract talks about arbitration but he breached taht contract. How can he get away with grand theft and stand behind this peice of paper. HELP
